What Investors Should Know About FS Energy Investments

FS Energy and Power Fund (FSEP) is a non-traded business development company that invests in the debt private U.S. energy and power companies. FSEP is designed to provide investors with access to alternative asset classes that are typically only available to big institutional investors.

Non-traded companies are sometimes associated with reduced oversight of their sales of unregistered securities, in addition to high sales commissions and due diligence fees that could give brokers an incentive to sell the product to customers who may not understand the inherent risk of the product or may have an investment profile that could make such products unsuitable to them. Those incentives could sometimes cause some brokers to not fully analyze the customer’s finances before making the recommendation. No allegations of misconduct are being made as to FSEP.

It is important to note that investment professionals have a duty to only recommend suitable investments to their customers based on the customer’s investor profile. To determine whether a product is suitable, the broker must first conduct adequate due diligence in accordance with the investment and have a reasonable basis to recommend it.

Investors who are concerned about their investment in products that might be qualified as high risk are encouraged to contact attorney Alan Rosca for a free consultation and discussion of recovery options, or to provide any useful information.
