Potential Compensation Claims

Unity Software Class Action Complaint Alleged Violations of Securities Laws

In May 2022, a class action complaint was filed against Unity Software Inc., John S. Riccitiello (CEO, President, and Executive Chairman), Kimberly Jabal (CFO until April 2021), and Luis Felipe Visoso (CFO since April 2021).

The plaintiffs alleged, among others, that the Defendants made false and misleading statements and/or failed to disclose Unity Software’s alleged deficiencies in Unity’s product platform which allegedly led to reduced accuracy of its machine learning technology. The complaint further alleges that due to the alleged deficiencies Unity Software failed to disclose the severity of the alleged data breach, and its impact on Unity Software’s commercial and/or financial prospects for 2022 were overstated.

According an 8-K Report filed on May 10, 2022, Unity Software announced its first quarter 2022 financial results indicating it reduced its fiscal 2022 guidance due to “challenges with monetization products.” According to the Q1 2022 Earnings Call Transcript published by The Motley Fool, John Riccitiello reportedly stated that on one hand internal issues with its platform caused reduced accuracy for its Audience Pinpointer tool, and on the other hand, Unity reportedly lost the value of a portion of its training data mainly due to “ ingesting bad data from a large customer”. Riccitiello also added that the estimated impact is approximately $110 million in 2022. On this news, the Unity price per share allegedly declined 37%, to close at $30.30 on May 11, 2022, the complaint states.

As a result, the plaintiffs sought damages, pre-judgment and post-judgment interest, as well as reasonable attorneys’ fees and costs, and expert fees. The class action is currently pending.
