Potential Compensation Claims

Has Sleep Number Been Accused of Misconduct?

Sleep Number Corp, Shelly R. Ibach, David R. Callen and several other Sleep Number executives have been the subject of two recent class action lawsuits alleging misconduct against them.

Sleep Number and its control persons are accused, among others, of allegedly making materially false and/or misleading statements, and/or failing to disclose that the company’s supply chain for foam had suffered a severe disruption during the Winter Storm Uri.

The complaints further alleged that contrary to representations made to investors, Sleep Number lacked supply chain flexibility and fail-safes to offset the foam supply disruption, which allegedly impaired Sleep Number’s ability to timely fulfill customer orders.

As a result, Sleep Number was allegedly forced to delay mattress shipments to end consumers, negatively impacting its financial results, the complaints allege.

What Happened to Sleep Number’s CFO?

On January 27, 2023, Sleep Number filed a press release announcing that its Chief Financial Officer (CFO) since April 2014 David Callen is “stepping down from his position to pursue other opportunities.” The release further announced that Callen will be replaced by Sleep Number Executive Vice President and Chief Human Resources Officer, Chris Krusmark, who will act as interim CFO.
