About Apyx Medical

Apyx Medical Corporation is a Delaware advanced energy technology company incorporated in 1982, with offices in Clearwater, Florida. Apyx reportedly designs, develops and manufactures electrosurgical equipment, with a focus on the cosmetic surgery market. The company’s stated mission is “To be the world’s leading innovator in unique energy solutions that transform physicians’ practices and patients’ lives.”

One of the marketed technologies developed by Apyx Medical Corporation is reportedly called J-Plasma, an energy modality reportedly designed to allow surgeons to use the energy on and around sensitive structures. According to Apyx marketing materials, J-Plasma is the technology behind Renuvion Cosmetic Technology, a procedure reportedly used in dermal resurfacing Procedures.

According to its website and regulatory filings, Apyx Medical Corporation is currently led by a management team that lists Charles D. Goodwin as President and Chief Executive Officer, Tara Semb as Chief Financial Officer, Moshe Citronowicz as Senior Vice President, and Todd Hornsby as Executive Vice President.

Apyx Medical commons shares are listed on Nasdaq under the symbol “APYX”. On July 22, 2022 the price per APYX share was $9.05, in decline compared to November 22, 2021 when it reached $17.40 per share, according to data from Google Finance.

Apyx Medical Corporation Class Action Complaints

In April 2019, Apyx Medical Corporation investors filed a class action complaint alleging violations of securities law in connection to certain materially false and/or misleading statements, as well as alleged failure to disclose surrounding the use of the J-Plasma technology for dermal resurfacing.

In June 2020 the parties to the Apyx class action filed a Notice of Settlement and the case was concluded a year later, in June 2021.

Additionally, a new class action case has recently been filed against Apyx Medical Corporation, Charles D. Goodwin II, and Tara Semb, on June 6, 2022.

The complaint alleges wrongful acts and omissions regarding the number of off label uses of Apyx’s Advanced Energy products, that allegedly led to the increase of number of medical device reports filed by Apyx reporting serious adverse events exposing Apyx to regulatory scrutiny.

According to the complaint, on Mach 14, 2022, Apyx reportedly issued a press release announcing that the company was “notified of pending FDA medical device safety communication related to its Advanced Energy products.” The press release further clarified that Apyx believes that the FDA’s communication will pertain to the “use of Advanced Energy products outside of their FDA-cleared indication.” The news allegedly had a negative impact on the price per APYX share, reportedly causing it to fall over $4, or more that 40% to close at $5.88 per share on March 14, 2022.

As a result, the plaintiffs requested compensatory damages plus interest, costs, and expenses, to include attorney fees and expert fees. As of July 26, 2022 the lawsuit is shown as pending.
